1. Acceptance of these terms

By accessing or using Atlantura, you agree to these Terms of Service and to any policies referenced on this page. If you do not agree, do not use the platform.

These terms apply to visitors, buyers, sellers, store team members, and any person who accesses Atlantura websites, stores, dashboards, or related services.

2. What Atlantura provides

Atlantura provides software and marketplace infrastructure that allows sellers to manage stores, publish products, create landing pages, receive orders, communicate with buyers, and receive payouts where available.

Some features may change, be improved, be limited by country, or be removed as the product evolves.

3. Accounts and access

You are responsible for keeping your login credentials secure and for all activity performed through your account.

You must provide accurate information and keep your profile, store details, contact details, and payout details up to date.

Atlantura may suspend or restrict access where account activity creates legal, security, fraud, compliance, or operational risk.

4. Buyer responsibilities

Buyers must provide accurate delivery and contact information, place legitimate orders, and pay all amounts due for confirmed purchases.

Cash on Delivery orders must be paid at handoff when the delivery person presents the order.

Buyers may not abuse returns, delivery confirmation flows, promotions, discounts, or messaging tools.

5. Seller responsibilities

Sellers are responsible for the accuracy, legality, and safety of their products, prices, descriptions, images, offers, and store content.

Sellers must fulfil confirmed orders, respect applicable consumer rules, and maintain valid business, identity, tax, and payout information where required.

Sellers may only sell products and content they are legally permitted to offer and must not upload unlawful, infringing, misleading, harmful, or fraudulent content.

6. Orders, payments, holds, and payouts

Order placement does not guarantee acceptance. Atlantura or the seller may reject, cancel, or limit orders where required by stock, fraud review, compliance, pricing integrity, operational limits, or force majeure.

When Cash on Delivery is used, no card is charged during checkout. Payment is collected only at delivery handoff.

A delivered order may remain in a delivered state during the payout hold window. Completion may depend on payout settlement status, operational confirmation, or applicable platform workflows.

Seller payouts may be subject to automatic hold windows, disputes, returns, refunds, compliance reviews, banking delays, or account verification requirements.

7. Platform fees and deductions

Atlantura may charge commissions, service fees, payment processing fees, or other clearly disclosed charges depending on the marketplace, country, product type, or enabled features.

Applicable fees may be deducted before seller payout where the product flow requires that deduction.

Taxes, duties, payment charges, shipping charges, refunds, and chargeback-related amounts may affect final settlement amounts.

8. Content and intellectual property

You retain rights to content you lawfully upload, but you grant Atlantura the rights needed to host, display, reproduce, process, and distribute that content for platform operation, support, security, moderation, and promotion of your store or listings.

You may not upload content that infringes third-party rights, violates law, impersonates others, or misleads users.

Atlantura, its software, branding, interface design, and platform content are protected by intellectual property laws and may not be copied or reused except as allowed by law or written permission.

9. Prohibited use

You may not use Atlantura to commit fraud, launder money, evade taxes, abuse promotions, scrape protected data, disrupt services, send spam, spread malware, bypass access controls, or violate laws or third-party rights.

You may not attempt to reverse engineer, overload, probe, or attack platform infrastructure except through lawful, authorized security disclosure channels.

10. Availability and changes

Atlantura aims to provide reliable service, but uninterrupted availability is not guaranteed. Maintenance, incidents, third-party outages, banking delays, logistics failures, or network issues may affect platform behavior.

We may update features, workflows, UI copy, pricing logic, operational rules, or policies when needed for product, legal, or security reasons.

11. Suspension and termination

Atlantura may suspend, limit, or terminate access to any account, store, listing, page, payout, or feature when reasonably necessary for legal compliance, fraud prevention, abuse mitigation, risk management, or platform integrity.

Termination does not remove obligations that arose before termination, including payment, refund, dispute, compliance, or record-keeping obligations.

12. Disclaimers

Atlantura is provided on an “as available” and “as is” basis to the maximum extent allowed by law.

We do not guarantee that the platform will always be error-free, uninterrupted, secure, or suitable for every commercial purpose.

Atlantura does not guarantee seller performance, buyer behavior, delivery performance, bank processing times, or the uninterrupted availability of third-party providers.

13. Limitation of liability

To the maximum extent permitted by law, Atlantura is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, reputation, data, opportunities, or business interruption.

Where liability cannot be excluded, Atlantura’s liability is limited to the amount permitted by applicable law and the specific circumstances of the claim.

14. Governing law and disputes

These terms are governed by the laws applicable to Atlantura’s operating entity and any mandatory consumer protection laws that apply in your country of residence.

Before escalating a dispute, you agree to contact support first so the issue can be reviewed in good faith.

15. Changes to these terms

We may update these terms from time to time. The updated version becomes effective when published on this page unless a later date is stated.

Continued use of Atlantura after an update means you accept the revised terms.
